These Terms govern your use of Strike.os (app.strike-os.com), provided by Hugo Aires Fangueiro Marques, a sole trader established in Portugal ("Strike.os", "we"). By creating an account or using the service, you accept these Terms. If you do not agree, do not use the service.
1. The service
Strike.os is an operations platform for marketing agencies: client management, social media content planning and publishing, a team calendar and billing. We may improve, change or discontinue features over time.
2. Account and security
You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and keep it up to date. Notify us immediately of any unauthorized use.
3. Acceptable use
You agree not to use Strike.os for unlawful purposes, to publish content that infringes third-party rights, spam, malware, or that violates the rules of connected platforms (Meta, Google, TikTok and others). We may suspend accounts that breach these rules.
4. User content and connected accounts
Content you upload and publish is your responsibility. You warrant that you hold the necessary rights to that content and your clients’ authorization to connect and manage their social media accounts through Strike.os. You grant us a limited license to store and process that content solely to provide the service (e.g. scheduling and publishing on your behalf). Strike.os is not responsible for the content you choose to publish.
5. Third-party integrations
Strike.os connects to third-party services (Meta, Google, Stripe and, in the future, TikTok). Use of those integrations is also subject to those third parties’ terms and policies. By connecting them, you authorize Strike.os to access and act on the connected accounts according to the permissions you grant, and you may revoke that authorization at any time.
6. Payments and subscriptions
Strike.os subscriptions, where applicable, are billed through Stripe according to the chosen plan, on a recurring basis until cancelled. Applicable taxes may apply. When an agency uses Strike.os to bill its own clients, that billing happens on the agency's Stripe account: the money is received by the agency, which is responsible for the commercial relationship, legal invoicing, disputes and refunds with its clients. Strike.os is not the merchant of record for those transactions.
7. Intellectual property
The Strike.os platform, software, brand and design are owned by us or our licensors. These Terms grant you no rights to Strike.os beyond the right to use it as set out here. Your content remains yours.
8. Disclaimers and limitation of liability
The service is provided "as is", without warranty of uninterrupted or error-free availability. To the maximum extent permitted by law, Strike.os is not liable for indirect damages, lost profits or data loss, nor for failures of third-party services outside our control.
9. Suspension and termination
You may cancel at any time. We may suspend or terminate access in case of breach of these Terms or use that endangers the service or third parties. After termination, your data is handled according to the Privacy Policy.
10. Changes to the Terms
We may update these Terms. Material changes will be communicated in the app or by email. Continued use after they take effect means acceptance.
11. Governing law and jurisdiction
These Terms are governed by Portuguese law. Any dispute is subject to the courts of Porto, Portugal, without prejudice to any rights granted to consumers by mandatory law.
